Developer Submission Agreement

This Developer Submission Agreement (this "Agreement") applies when you submit a game, artwork, audio, description, or any other material ("Submitted Content") to Vibecade. By submitting content, you agree to these terms. If you are submitting on behalf of a company or team, you confirm that you are authorized to bind it to this Agreement.

1. Ownership

You retain full ownership of all intellectual property rights in your Submitted Content. Nothing in this Agreement transfers ownership of your work to us. We claim no rights in your Submitted Content beyond the limited license described below.

2. License to Vibecade

You grant Vibecade a non-exclusive, worldwide, revocable, royalty-free license to host, display, distribute, and promote your Submitted Content in connection with the Vibecade platform. This license includes the right to:

• Host and serve your game to players through our website
• Display screenshots, thumbnails, titles, and descriptions of your Submitted Content on Vibecade and in listings, search results, and recommendations
• Use your Submitted Content's name and imagery to promote it and the Vibecade platform, including on social media and in newsletters

This license exists solely so that we can operate and promote the platform. It ends when your Submitted Content is removed, except for copies retained in backups or as required by law, and except for promotional materials already published.

3. Non-Infringement

You represent and warrant that you have the right to submit your Submitted Content and to grant the license above, and that your Submitted Content:

• Is your original work, or that you have written permission to use every element it contains, including code, art, music, sound effects, and fonts
• Does not infringe any copyright, trademark, patent, trade secret, privacy, publicity, or other right of any third party
• Does not violate any applicable law or regulation
• Does not contain malware, tracking beyond what you have disclosed to us, or code intended to damage or gain unauthorized access to any system

We may remove Submitted Content that we believe in good faith infringes third-party rights or violates this Agreement, without prior notice.

4. No Derivative or Sublicensing Rights

We will not modify your Submitted Content, create derivative works from it, or sublicense it to third parties without your written consent. This does not restrict routine technical processing necessary to host and deliver your work — such as compression, format conversion, generating thumbnails, or adapting the display to different screen sizes.

5. Content standards

Vibecade is a general-audience games site. Submitted Content must not contain sexually explicit material, gratuitous violence, hate speech, harassment, or content that promotes illegal activity or self-harm. It must not contain advertising, analytics, or data collection that you have not disclosed to us in writing. We may decline or remove any submission that we determine is not a good fit for the platform.

6. Compensation

Unless we have agreed otherwise in writing, submitting content does not entitle you to payment or revenue sharing. If we later offer a revenue share, licensing fee, or other compensation program, its terms will be set out in a separate written agreement.

7. Removal and termination

You may request removal of your Submitted Content at any time by contacting us. We will stop new distribution within a commercially reasonable time after your request. We may also remove Submitted Content or terminate this Agreement at any time and for any reason.

Sections 1, 3, 8, and 9 survive termination of this Agreement.

8. Disclaimers and liability

The Vibecade platform is provided "as is." We do not guarantee any level of traffic, availability, revenue, or promotion for your Submitted Content. To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your submission.

9. Indemnification

You agree to indemnify and hold harmless Vibecade and its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your Submitted Content or your breach of this Agreement, including any claim that your Submitted Content infringes a third party's rights.

10. Acceptance and general terms

This Agreement incorporates our Terms of Service and Privacy Policy. Together they are the entire understanding between us regarding Submitted Content, and they replace any prior discussions on the subject. If any provision is found unenforceable, the remaining provisions stay in effect.

We may update this Agreement from time to time. If we make material changes, we will update the "Last updated" date above. Changes do not apply retroactively to content already submitted unless you agree to them.
